The process of Mediation falls under the Alternative Dispute Resolution Umbrella. Established under section 154.052 of the Texas Civil Practice and Remedies Code, mediation strides alongside arbitration, moderated settlement conferences and various other methods of alternative dispute resolution. Mediation has become an integral part of our civil justice system as most Courts require parties to mediate before going to trial. Practiced a number of different ways, mediation is a process in which a neutral third party attempts to facilitate a discussion between the parties to reach a solution.
